These Terms and Conditions ("Terms") govern your use of the Agra Pro website (agrapro.eu) and our workforce leasing services. By accessing or using our platform, you agree to be bound by these Terms.

1. Service Description

Agra Pro operates a workforce leasing and recruitment platform that connects:

  • Job seekers (primarily from Poland) looking for employment opportunities in agriculture and construction in Germany, Austria, and the Netherlands
  • Employers in Germany, Austria, and the Netherlands seeking qualified workers for agriculture, construction, and related industries

We act as an intermediary, facilitating the connection between candidates and employers. We are not a party to any employment contract between candidates and employers.

2. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

3. Candidate Terms

  • Our recruitment services are completely free of charge for candidates. We never charge job seekers any fees.
  • By submitting your profile and CV, you authorize us to share your information with potential employers for job matching purposes.
  • You are responsible for the accuracy of the information you provide, including qualifications, experience, and availability.
  • We do not guarantee placement in any specific position. Job offers depend on employer requirements and availability.
  • You may withdraw your profile and data at any time by contacting us.

4. Employer Terms

  • Employer accounts may require approval by our team before activation.
  • Employers agree to provide accurate information about job positions, working conditions, compensation, and accommodation.
  • Employers must comply with all applicable labor laws in their country of operation, including minimum wage, working hours, and occupational safety regulations.
  • Employers are responsible for the legal employment of workers, including contracts, insurance, and tax compliance.
  • Service fees for employers are outlined in separate commercial agreements.

5. Prohibited Conduct

Users must not:

  • Use the platform for any unlawful purpose
  • Submit false, misleading, or fraudulent information
  • Harass, discriminate against, or exploit other users
  • Attempt to circumvent security measures or access restrictions
  • Scrape, crawl, or collect data from the platform without authorization
  • Post misleading job offers or recruitment scams

6. Intellectual Property

All content on the Agra Pro website, including text, graphics, logos, icons, images, software, and design elements, is the property of Agra Pro or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Agra Pro provides the platform "as is" without warranties of any kind, express or implied
  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform
  • We are not responsible for the actions, conduct, or quality of work of any candidate or employer
  • We do not guarantee the accuracy of information provided by other users
  • Our total liability for any claim arising from these Terms shall not exceed the amount you paid us (if any) in the 12 months preceding the claim

8. Indemnification

You agree to indemnify and hold harmless Agra Pro, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform or violation of these Terms.

9. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the platform after changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
